Any and all reference to the use of the words "us", "our", "ours" and "we" accordingly refer to U Ponics. This website service is provided for the convenience of the customers and patrons of U Ponics, and the use of this service is subject to the TERMS AND CONDITIONS OF SERVICE (hereafter referred to as "terms" / "policy") as contained within this document.

The use of this website is conditional on the acceptance of these terms. By using this platform (www.uponics.co.za), you agree unconditionally to the terms as set out in this document. If you do not agree to and/or accept such terms, then you are not permitted to make use of this website and/or any of the services provided therein.

Website Terms & Conditions

By making use of this service you agree that you are considered a major for the purposes of concluding a contract in in the Republic of South Africa. Or, you are a major for the purposes of concluding a contract, and consent to our business contracting with any such minor who acts with your consent. Or, that you are a minor residing in the Republic of South Africa, who has obtained the requisite consent to contract, be it through the consent of your parent/guardian or emancipation.

You are not permitted to make use of this website for illegal/unauthorized purposes, and are not permitted to attach/transmit any viruses, worms or malware onto this platform.

Any breach or violation of the terms contained herein will result in a breach of contract which constitutes a termination of your services as provided for by www.uponics.co.za.

General Terms of Services

By using this website and agreeing to these terms, you understand fully that U Ponics maintains the right to refuse service to any person, for any given reason.

You understand that your information (including contact number, social media handles and email address, and excluding any credit card details) will be retained by U Ponics, and may be used for, or to convey any promotional material via our communicative channels, including but not limited to our business WhatsApp line, and Instagram account.

U Ponics will never willingly divulge any of your personal information to any third party without your express consent, and all credit card details are always handled via the appropriate encrypted channels.

U agree to not make use of, distribute or duplicate any copyrighted material produced by U Ponics or used within its website (www.uponics.co.za) without the express approval of the management of U Ponics.

Livestock Policies:

All living organisms are non-refundable and non-returnable (with limits).

It is your responsibility to research:

• compatibility with other livestock
• water conditions & quality
• acclimation procedure

Please ensure you are capable of caring for the organism before making the purchase. Once the organism leaves the store, they are your responsibility.

Under the Consumer Protection Act (CPA), you have the right to goods that are of good quality and free of defects. We will not sell livestock that are showing visible symptoms of sickness or are under treatment.

Please make use of our communication platforms (Call/WhatsApp/Email) for enquires on livestock health from our certified aquarist (Taariq Logday, BSc | Aquaculture Certified).

Travel Safety

When shipping livestock, we will package them to the best of our ability for a safe trip to their destination. Once livestock has left the store, they are out of our possession and there is no guarantee that they will arrive safely.

We recommend finding your own trusted courier for collection and transport within 3hrs. It is best to transport in a temperature-regulated container.

We reserve the right to refuse the sale of live animals if we believe the customer cannot provide suitable care. (Animal Protection Act)

Certain species may require permits under South African environmental regulations. The customer is responsible for ensuring compliance where applicable.

The store shall not be liable for consequential losses including loss of other aquatic livestock.

It is good practice to quarantine and treat fish, plants and other invertebrates before introducing them to your aquarium.

Payment
